Terms of Service & End User License Agreement

These Terms of Service and End User License Agreement ("Terms") are a binding agreement between you and Sweaty ("we", "us") governing your use of the Sweaty mobile application and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Sweaty. By creating an account you represent that you are 18 or older and that all information you provide, including your date of birth, is accurate. We may suspend or terminate accounts that misrepresent age or identity.

2. Your account

You are responsible for your account and for keeping your login credentials secure. You may only create one account, for your own personal, non-commercial use. You may delete your account at any time from Settings inside the app.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, in accordance with these Terms and Apple's App Store Terms of Service. This license is for personal use only. We (and our licensors) retain all rights in the Service.

4. User content and zero-tolerance policy

You are solely responsible for the content you post — photos, profile information, and messages ("User Content"). By posting User Content you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute it solely for the purpose of operating the Service.

To keep the community safe, the Service includes:

• Automated filtering of uploaded images and of text in bios and messages for objectionable content;
• Reporting — you can report any user or content from their profile or the chat;
• Blocking — you can block any user, which removes them from your experience entirely and prevents further contact.

5. Prohibited conduct

You agree not to:

• Post objectionable, sexually explicit, violent, hateful, or illegal content;
• Harass, abuse, stalk, threaten, or defame other users;
• Impersonate any person, misrepresent your age or identity, or create fake profiles;
• Use the Service for commercial solicitation, advertising, or spam;
• Attempt to access other users' accounts or data, or interfere with the Service's operation or security;
• Use the Service in violation of any applicable law.

6. Safety

Sweaty connects people for real-world activities. We do not run background checks on users and are not responsible for users' conduct, online or offline. Use good judgment: meet in public places, tell someone where you are going, and never share financial information with other users.

7. Purchases and subscriptions

The app may offer optional paid features or subscriptions, billed through your Apple ID. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel them in your App Store account settings. Payments are processed by Apple — we never see your payment details. Except where required by law, purchases are non-refundable; refund requests are handled by Apple.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms, without prior notice. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including content licenses needed to wind down, disclaimers, and limitations of liability) survive.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or availability. We do not guarantee that you will find matches, partners, or activities, or that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising from your use of the Service — including interactions or meetings with other users. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Apple-specific terms

These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes

We may update these Terms from time to time. If changes are material we will notify you in the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer protections of your country of residence. Disputes are subject to the non-exclusive jurisdiction of the courts of Portugal.
